Verified Buyer |SAFETY INCIDENT - US XPRESS - TRUCK LP03544
Driver of US Express truck LP03544 (USDOT 0303024), on October 12, 2023, at approximately 1:42 PM, knowingly changed from left to right hand lane on I-10, just past mile marker 7 (Vinton LA, Exit 7), with my truck half way up the length of his trailer.
Truck LP03544 was in the left hand lane as we past the sign on I-10 for EXIT 7.
I coming up on the truck in the right hand lane.
The truck driver put his right hand signal light On.
I seen this and proceeded up the right side of the truck trailer accelerating slightly as to clear the truck and allow him to make the lane change.
When I was approximately half way up the trailer the driver of of the US Express truck started into the right hand lane.
Given a choice of allowing the truck to hit my truck or take to the side of the interstate, I chose the side of the interstate.
Due to construction, there was no shoulder, just a steep embankment.
At approximately 65 MPH truck right tires slipped off of the pavement setting the truck into a sideways skid down the steep embankment.
Seeing a concrete culvert approaching quickly, tried braking which resulted in truck feeling like it was about to flip.
Pressed to accelerator to attempt to power the vehicle back up onto the payment.
This worked and the vehicle powered back up the embankment onto the pavement of the interstate.
But now my truck is sideways coming onto the interstate into oncoming vehicles.
I managed to brake quickly and bring the vehicle to a momentary hault in the sideways in the right lane of the interstate.
Then quickly accelerated into a hard right hand turn to get out of the path of ongoing traffic.
Looked down the interstate and seen the US Express truck that had just ran me off the road taking the Exit 7 ramp off of the interstate.
Pulled up behind the truck where I could be seen and signalled the driver with horn and my truck signal light to pull to shoulder.
The driver proceeded through the intersection South onto West St.
The truck then proceeded into the Love's Truck Stop, truck entrance.
When there was Safe room in the fuel area to pass on the right side of the truck, I pulled around to the front of the truck and gave the driver a hand signal requesting he stop.
The driver turned hard right and accelerated past my truck barely missing back bumper.
Driver came to a stop behind another truck and trailer in one of the fuel lines.
Parked Safely on the side of parking lot and walked over to the truck.
Initially the driver got out of his seat and disappeared in the sleeper area of the truck.
Then he came out and opened the door of the truck.
I asked him if he saw me on the interstate when he started in the right hand lane.
He replied asking me if I saw his signal light.
I replied, "Yes, that's why I was attempted to accelerate on by you, where you could get over."
He started cursing and caring on about that I should have gotten out of his way.
I asked him if he seen that he forced me off of the interstate.
He replied, "Yes, that's what the *** get for being in the way when I want to get the *** over.
At this point I knew the driver didn't care about the Safety of others and this was a waisted effort.
Took pictures of the truck, trailer and driver.
Called US Express and requested to talk to the Director of Safety.
The lady I talk to took the information from the incident and assured me there would be a follow-up with Manager and driver.
Told the lady I was not attempting to get the driver fired from his job as this is the way he supports his family.
Asked for the following:
Driver issue me and my family a written letter of apology.
Driver pay out of his pocket for my vehicle to cleaned and inspected inclusive of the undercarriage,
Driver receive training needed to prevent this type of incident from happening again.
Lastly, that I receive documentation from company that driver was notified and that this was going to be done.
FACTS OF INCIDENT:
Driver was traveling in LEFT hand land in construction zone signs clearly indicating the left hand lane was for passing only.
Driver waited till the last minute to get into the right hand lane in order to take his exit.
Driver seen the vehicle coming up the right hand side of his trailer before starting to switch lanes.
Driver ran vehicle off the road and kept on going with no concern or apparent remorse for his actions.Dr

Hello. I'm writing this maybe a manager will see it and take action.
I called on a posted load from NJ to CA for Monday. June 12. The guy didn't give me his name. I tried to tell him that I already filled up the packet 2 days ago and he just hung up on me.
Called him back and ask why he did that. He said because I can and I don't care about you. Asked him what's with the attitude and why he's talking like that.
Gives you the right to do so because you're a broker and carriers don't count. His response was YES
